Did you remember to initialize h5Validate? (see the jump start section here: http://ericleads.com/h5validate/ )

Can you reproduce the problem on jsfiddle.net and post the link?

Cant really post it to the site as the form contains data from within our corporate CI but I mis-stated something, the form fields (borders) do get marked with css as being invalid but the focus does not stay on the field, and yes I have this near the bottom of the form <script>

H5Validate does not automatically validate on submit (it's optional), nor will it automatically set focus on the first invalid field. Instead, it provides realtime inline feedback as the user is completing the fields. That said, it should be easy to use jQuery to make that happen.
