I think https://01.org/clear-SANS and http://clear.positype.com/ are two different fonts? Does the Intel Clear Sans infringe on Neil Summerour's trademark on the name Clear Sans?

Intel didn't want to do that. I'll spoke with Neil about this a while ago
abs I'll see him next week and hopefully resolve it with him then

Stumbled upon this issue when I first learnt of this font and grew curious why Google Fonts and Adobe Edge Web Fonts don't host it. Quite a shame IMHO that it is (still) relatively unknown to the bigger part of the FLOSS community.

I was surprised to see that Intel didn't budge on this issue, so I did some digging and discovered something interesting:
- Intel has a blog post on the initial release of Clear Sans, dated June 24th, 2013.
- Mr. Summerour's trademark application wasn't filed until November 23rd, 2013 (citing first commercial use as 10/20/13).
IANAL, but wouldn't that make the trademark invalid/unenforceable? @davelab6

I found an even older example in the form of this Bugzilla ticket, dated May 29th, 2013, where it was first added to testing versions of Firefox for Android.
They appear to have used it as the default sans-serif font since then without issue.
