I think we should be more specific about when a Patient in the bundle is proper. I think it is only proper in PUSH interactions. It should never be used in registry or query..

2:3.65.4.1.2.2 Patient Identity

All DocumentReference.subject, and List.subject values shall be References to a FHIR Patient Resource. This value may be a relative reference to a Patient Resource within the Bundle or an absolute external reference (URL). This value should be an absolute external reference that may be obtained through use of PDQm or PIXm, or by some other means. The Document Source should only use Patient Resource within the Bundle when there is policy expectation that the Document Recipient will accept it, and where no online means of Patient Identity resolution is available. The Patient Resource needs to be accessible to both the Document Source and the Document Recipient.

Suggested text:

If the Patient Resource is accessable to both the Document Source and Document Recipient via an external reference, it shall be included as an external reference. Otherwise, the Patient Resource shall be included in the Bundle.
