Just like a View or a Surface, you can pass along a size to a LayoutController. Only when the size is known for a renderable can it be aligned using a modifier. The background surface will automatically inherit the size of the parent so you don't have to specify it for that surface anymore. The following should work:

 var footer = new LayoutController({
        size : [undefined, 80],
        layout : NavBarLayout,
        layoutOptions : {
            margins : 0,
            itemSpacer : 0
        },
        dataSource : {
            background : new Surface({
                properties : {
                    background : 'red'
                }
            })
        }
    });

    context.add(new Modifier({
        origin : [0.0, 1.0],
        align : [0.0, 1.0]
    })).add(footer);

Ah, my bad.

I've switched to HeaderFooterLayout by now anyway for the examples repository, since it's a more expressive way of defined the layout.
