Been doing a bit of research on this. There's a few differing opinions.
@Lextuga007 has rightfully pointed out that although we are public sector employees in the NHS, we are not 'Civil Servants'.
From what I can see of the copyright act, and reading civil service stuff, we are never defined as 'servants of the crown.' That said, NHS Scotland , NHS England (and NHS Digital as was) all seem to apply the Crown Copyright. NHSE goes further to state that OGL is required, but all accept MIT.
As far as I'm aware, OGL is not software specific and designed to go with other licences anyway.
I propose we stick with just MIT, and more broadly at NHS-R (and our own organisation), but we need to state an opinion on crown copyright here. I don't see any harm in it, but it might not be strictly correct.

Discussed this at the catch up for the package and agreed it will be taken to the NHS-R Community Committee in the new year as a discussion on licences and copyright affects all repositories. Thanks for raising.
