I took the liberty of editing your post with the images displayed inline. Github takes care of caching the images so it doesn't waste your dropbox bandwidth.

I've found some of the log files that might be useful for debugging this issue

The test run that I did to generate the log files was : boot with GSnull driver in HW mode, let the menu and save file load walk a bit in-game and then switch to software mode (without quitting the game first) and the walk a bit more before finally shutting down the VM and exiting the pcsx2.exe

My question is now does pcsx2 gsdx's sw mode render some things different except not having as much graphical options as hw mode. Like does it render textures, meshes or text different than hw mode which may cause the graphical issues that you don't have in sw mode.

Because I found when you run the game in HW mode and you change an option in the gsdx plugin (except changing to SW mode, but say the aa level) while the game is running and then press OK in the plugins option menu and the game goes in a flash black after that you can see a flash were the text and such are rendered correctly and then the game goes back to normal with the text and such not rendering in hw mode.

Thanks, edited the first post with this info. Also I guess this part: -Other comments: It's the usual GSdx hardware issue with videos, which occurs in lots of games.
Was just a copy/paste error

Alright it's been awhile since I've tried running the game again in hw mode. But today I felt the urge to test it again on a re-installed stable release of 1.2.1. So I did that and when I ran the game (full boot) I noticed this when it came to the title screen.

I don't really know if it has anything to do with my problem but it's the first time it showed up so I'd better report on it.

Is that on D3D9?. If so, you can ignore it.
I've changed it on latest dev builds, so that it let's you know it won't work if you're running GSdx9.

(sorry for my late reply) No, it's on D3D11. So does this change anything or is this just a dead end. Because the game runs terrible on SW mode (not unplayable but terrible).

This is now fixed with OpenGL HW using blending unit accuracy basic or higher.
Has some upscaling issues and got a random crash but this is definitively fixed. Tested NTSC version but this is 99% fixed for PAL too.
