BTW if you only introduced enumitem to adjust the number style, another option would be to drop it completely and only use the doclicense@enumitem definition I have introduced for enumitem=false.
I can update my PR if required.

With the second commit in the pull request, enumitem-less version now follows the label style in #8 without the unnecessary \advance\@enumdepth\@ne hack, so #36 does not re-occur with enumitem=false.

Sounds good to me. Please do that. I tested #41 and I found no issues with the alternative fix.
